1. Acceptance of Terms

By accessing or using WishMetric ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service. We reserve the right to update these terms at any time, and your continued use constitutes acceptance of any changes.

2. Description of Service

WishMetric is a SaaS platform that allows you to create and manage beautiful waitlist pages for your products, ideas, and services. Our service includes:

  • No-code waitlist page builder with customizable themes
  • Email collection with OTP verification
  • Referral tracking system
  • Analytics dashboard for tracking signups and page views
  • Bulk email announcements to your waitlist (Pro feature)
  • Custom vanity URLs (Pro feature)

3. Account Registration

3.1 Eligibility

You must be at least 13 years old to use WishMetric. By creating an account, you represent that you meet this age requirement and have the legal capacity to enter into these Terms.

3.2 Account Security

You are responsible for maintaining the security of your account. We use Google OAuth and OTP-based authentication for enhanced security. You must notify us immediately of any unauthorized access to your account.

4. Subscription Plans

4.1 Free Plan

Our free plan includes:

  • 2 Projects
  • 2,000 Signups per Project
  • WishMetric Branding on pages
  • Standard URLs (wishmetric.sylexify.com/p/your-project)
  • Community Support

4.2 Pro Plan

Pro plan includes all Free features plus:

  • Unlimited Projects
  • Unlimited Signups
  • Remove WishMetric Branding
  • Custom Vanity URLs (wishmetric.sylexify.com/your-username/project)
  • Email Verification for Signups (OTP verification)
  • Priority Email Support
  • Analytics Dashboard
  • Export Subscribers to CSV

4.3 Pricing

  • Monthly: $5/month (billed monthly)
  • Yearly: $50/year (save $10 compared to monthly)
  • Lifetime: $50 one-time payment (limited early adopter offer for first 11 users)

5. Payment Terms

  • All payments are processed securely via Dodo Payments
  • Subscriptions auto-renew unless cancelled before the renewal date
  • You may cancel your subscription at any time from your dashboard settings
  • Refunds are handled on a case-by-case basis within 7 days of purchase
  • We reserve the right to change pricing with 30 days notice to existing customers
  • Lifetime plans do not expire and grant permanent Pro access

6. Acceptable Use Policy

You agree NOT to use WishMetric to:

  • Create pages for illegal products, services, or activities
  • Collect emails for spam, phishing, or fraudulent purposes
  • Infringe on intellectual property rights of others
  • Distribute malware, viruses, or harmful code
  • Harass, abuse, or harm other users
  • Attempt to bypass security measures or access unauthorized data
  • Use automated scripts to abuse the service (excessive API calls, scraping)
  • Resell or redistribute the service without authorization

Violation of these terms may result in immediate account suspension or termination without refund.

7. Content Ownership

7.1 Your Content

You retain full ownership of all content you create on WishMetric, including project content, branding, and collected email addresses. You grant us a limited license to host and display your content solely as necessary to provide the service.

7.2 Our Content

WishMetric's platform, design, code, and branding are owned by us. You may not copy, modify, or redistribute our platform without written permission.

8. Email Communications

As a project owner using our email features, you are responsible for:

  • Complying with anti-spam laws (CAN-SPAM, GDPR) when emailing your waitlist
  • Honoring unsubscribe requests from your waitlist subscribers
  • Not sending deceptive or misleading emails
  • Only emailing users who have opted in via your waitlist
  • Ensuring your email content does not violate any laws or third-party rights

9. Service Availability

We strive for high uptime but do not guarantee uninterrupted service. We may perform maintenance, updates, or experience outages. We are not liable for any losses resulting from service interruptions. We will try to notify users of planned maintenance in advance.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WISHMETRIC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS.

11. Termination

  • You may delete your account at any time from your dashboard settings
  • We may suspend or terminate accounts that violate these Terms
  • Upon termination, your data will be soft-deleted and permanently removed after 30 days
  • You may request a data export before account deletion (Pro feature: CSV export)
  • Termination for Terms violation does not entitle you to any refund

12. Dispute Resolution

Any disputes arising from these Terms shall first be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with applicable laws. You agree to waive any right to participate in class action lawsuits.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any legal proceedings shall be conducted in the courts of India.
